1. What This Service Is

NBAPlayDB is a search engine and discovery tool that helps users find and organize short NBA video clips. The Service provides a way to search through play-by-play data and, upon user request, merge selected clips into a single video file.

NBAPlayDB is a tool, not a content publisher or distributor. We do not host, stream, or distribute NBA video content. All video clips referenced by the Service are hosted on NBA.com and remain under the control of the National Basketball Association ("NBA").

The Service processes video content only when you specifically request it. Any merging or processing happens on our infrastructure solely at your direction.

2. Third-Party Content

All NBA video content, trademarks, logos, team names, player names, and related materials are owned by the NBA, its member teams, or their respective licensors. NBAPlayDB does not own, license, or have any rights to this content.

We do not claim any ownership of or rights to NBA content. The Service merely provides tools to help you search and organize publicly available information.

Your use of any NBA content is governed by NBA.com's Terms of Use and any applicable copyright laws. It is your responsibility to review and comply with those terms.

3. Your Responsibilities

By using the Service, you agree that:

• You are solely responsible for how you use any content accessed through the Service
• You will comply with all applicable laws, including copyright laws
• You will comply with NBA.com's Terms of Use when accessing NBA content
• You will not use the Service to infringe on any third-party rights
• You will not attempt to circumvent any technical limitations of the Service
• You will not use the Service for any unlawful purpose

We provide tools; how you use them is your responsibility.

NBAPlayDB does not monitor, review, or control how users select, process, download, or use third-party content.

4. Personal, Non-Commercial Use Only

The Service is intended for personal, non-commercial use only. You may not use the Service or any content accessed through it for commercial purposes, including but not limited to:

• Selling, licensing, or distributing merged videos
• Using videos in commercial productions or broadcasts
• Monetizing videos on social media or video platforms
• Any other commercial exploitation

If you wish to use NBA content commercially, you must obtain appropriate licenses directly from the NBA or its authorized representatives.

5. Processing and Temporary Storage

When you request video merging, the Service temporarily processes and stores the resulting video file on our infrastructure (AWS). This processing happens only at your explicit request.

Merged videos are stored temporarily and are automatically deleted after a few days. We do not maintain a permanent archive of merged videos.

You may download merged videos during the temporary storage period. Once deleted from our servers, videos cannot be recovered.

6. Payments

Certain features of the Service require payment. Payments are processed through Stripe.

Payment gives you access to premium features of the Service. Payment does not:

• Grant you any rights to NBA content
• License any copyrighted material to you
• Transfer ownership of any content
• Authorize commercial use of any content

You are paying for access to our tools, not for content rights.

Payments are non-refundable except where required by applicable law. For billing inquiries, please contact us.

7. No License Granted

NBAPlayDB does not grant you any license, permission, or rights to use NBA content beyond what is permitted under NBA.com's Terms of Use and applicable law. All rights to NBA content remain solely with the NBA, its member teams, and their licensors.

8. Indemnification

You agree to indemnify, defend, and hold harmless the operator of NBAPlayDB from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your misuse of any third-party content, including NBA content
• Your violation of any applicable law or third-party rights

9. Copyright Complaints

We respect intellectual property rights. If you believe that content accessible through the Service infringes your copyright, please contact us at [email protected] with the following information:

• A description of the copyrighted work you claim has been infringed
• A description of where the allegedly infringing material is located
• Your contact information
• A statement that you have a good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

We will cooperate with legitimate copyright holders and may remove or disable access to content in response to valid complaints.

10. Account Suspension and Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Misuse of the Service
• Requests from law enforcement or other government agencies
• Copyright infringement claims
• Conduct that we believe is harmful to other users, third parties, or the Service

You may also delete your account at any time by contacting us.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Any defects will be corrected
• The results obtained from using the Service will be accurate or reliable
• Third-party content will remain available or accessible

You use the Service at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, the operator of NBAPlayDB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve months preceding the claim, or €100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If you are in such a jurisdiction, some or all of the above limitations may not apply to you.

13. Changes to the Service and Terms

We may modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
